Abby & Libby - The Delphi Murders - Richard Allen Arrested - #200

Has anyone ever speculated about what it could be that only the killer would know?

Never really thought about it until now...

I've wondered if any of his statements included something specific (like "I heard one of them say..." or a description of how he spotted & approached the girls) that could be easily compared to & confirmed by the phone video. I could see him getting out a statement like that before his wife told/warned him to stop talking. Just pondering; MOO.

This leads me to another question...

IIUC... LE are required to report when their guns are drawn/handled in the course of any case...
If this bullet was from a gun of LE...
Ideally speaking...
would there not be a report of a gun related action by the LE?

JMO...
In a perfect world, LE reports on every bullet they spend/fire

They were approved twice by the people appointed by JG to do the approving, once for the periodical magazine and once for The Franklin Daily Journal newspaper. They were told both times yes those affiliations are included as acceptable, by the rules written. Both times they were later informed JG said no to them. Aine has been a journalist for quite awhile.

If you read the file I attached the guidelines/qualifications/credentialing are established in the Indiana State Code, making it a law. The first criteria, it's full-time employment with a licensed media outlet.

JB doesn't have any authority to override Indiana State Law. Not sure who told them it was OK. Keep in mind podcasters can report anything without accountability under the law with a simple disclaimer .... for entertainment purposes only.

The judge is going to follow the Law.

Delphi trial day 2 was a bit of an abbreviated day in court. This tread has the latest.

State calls Steven Mullin, the current Carroll County prosecutor’s investigator. He was the Delphi police chief at the time of the crime.

Mullin testified to his timeline of events the girls went missing. He also drew on a map to point the jury to a few geographical locations near the Monon High Bridge.

State calls their 7th witness, Jake Johns.Johns is a delphi resident who testified to his timeline the day the girl’s bodies were found. He was part of the search efforts and found Libby’s shirt in the water.

During cross examination the defense asked about sound on the trails, Johns testified that sound traveled easy out there.

State calls witness 8, Pat Brown.Brown is a delphi resident, he found the girls bodies.

Brown got emotional during testimony, and had to pause to compose himself when describing the moment he saw the bodies. “We found them… I thought they were mannequins.”- Brown said

During cross examination the defense asked about Brown was asked about sound on the trails. He testified that you could hear fine out there. He also said he had cell service at the area where he found the bodies.

Court adjourned at 11:35 am and will be back Monday at 9am.

IANAL but my two (three in this case) cents:

- If the P claims the phone was activated because of animal activity, the D can say 'but there are no large animals'
- If there was no animal activity on the bodies, they can point out that - hey, there are feral animals, we expected to see animal activity so they must have been killed at a later point, closer to discovery
- Hairs/fibers (like the Nancy Grace - RA's house cat theory), if there were animals then the fur could match

IMO it is a question that lays out groundwork for theories that could benefit the D, no matter how it is answered. I don't see why it would not be permitted.

All MOO

So, if there is predation it can be argued one way and if none argued another.

That cell phone turning on after 4 am is pivotal when it comes to proving the why, how and who.

And aren't private citizens the public? Or is there some legalese Iunderstanding?

As always, JMO.
The court has NO obligation to provide evidence to the general population in the courtroom.

The judge and law require information/evidence be provided to the defendant and a jury of his peers.

I'm not aware of any law or legal obligation .... maybe one of our attorneys could chime in, for the judge to provide an opportunity for the general public to review evidence during a trial. Never heard of such.

I explained in my post who approved them twice, two separate people assigned by JG to do so.

Is it correct information that JG is not letting the public view the exhibits, even though they are allowed to do so under the law? Or is it discretionary and the judge can set different rules?

Maybe timing is important? Does the law say after the trial is over is when the public can view the exhibits?

As always, JMO.

Maybe they made a mistake the first time and realized their mistake?

Good for her in not supporting a man who has confessed 60+ times and placed himself at the crime scene.

I’d like to know more about that photo of her on the bridge. Like how did that come about? Was her father present when that photo was taken?

I find it interesting she hadn’t been in court, and I think it’s likely she is set to testify against him.

I'd be more concerned if she had stated, "the voices match!" or "they have matched the voices!" as we've no evidence of such thus far.

But, voices certainly "can be matched" ... as we all know. As part of the Nancy Grace Team, this tweeter is also well accustomed to that capability being utilized in prior cases with "audio" available as evidence:

Whether or not BG & RA's voice has actually been matched ... only time will tell.
Bringing forth this post from yesterday that was in response to "They can match the voices!"

Can you provide the law?

Never, ever heard of a judge allowing a special viewing time or even citizens to come forward and review evidence.

I see it still says pair of black Nikes and shoes, not shoe.

As always, JMO.
If the Prosecution has said numerous times, in court and the PCA, the information that Libby's phone was under Libby's shoe under Abby's body and Abby had both her shoes on her feet minus socks, how many shoes from the victims is left? It must then logically be an error by WISH-TV.
