Conflicting information for some reason.

 
Sure seems like they did about 10 days ago.

“You mean after he was taken to Westville (Correctional Facility in solitary confinement) without a hearing?” Baldwin asked. “After he was taken to Westville without an attorney? After he was taken to Westville without any evidence that the safekeeping statutes were met? You mean then?”

Baldwin and Auger maintain that Allen’s return to Westville to begin serving his prison sentence while his appeal process begins has put his well-being in jeopardy.

”I don’t know why they consistently treat Richard Allen differently than any other person charged with or convicted of a crime in this state,” said Auger. “Westville wasn’t able to keep him safe when he was there the first time. By their own doing they made him unsafe. By their failure to properly diagnose, their failure to properly treat. The failure to keep him safe under his conditions of confinement. They put him at danger in his mental health. Now he’s being guarded by the very people we cross-examined in court. That’s a problem.”


I can feel Baldwin's & Auger's conniving desperation leaking through my screen. RA was found guilty and is serving his 130 year sentence as a convicted child murderer.

It kills me to read this little diddy by Auger:

"Westville wasn’t able to keep him safe when he was there the first time. By their own doing they made him unsafe. By their failure to properly diagnose, their failure to properly treat. The failure to keep him safe under his conditions of confinement. They put him at danger in his mental health".

NO, it was his own unethical and incompetent Defense Team that kept his mental health in danger by not ordering an independent mental health evaluation and treatment of their own Client, whom they professed such immense care and concern for. WTH was the IDOC to do other than treat him the best they could with the resources they had?

The D made a calculated choice not to because they were afraid of what RA might say in an independent evaluation, which they would have to turn over to the State in Discovery. They made a calculated roll of the dice at RA's expense.

Westville did a good job of keeping RA safe and thank heavens he was monitored in cell by video and by cam on his outside walk arounds. RA's the one who chose to strip, eat or smear human excrement, bang his head against the wall, etc. for that time period when RA dropped the confession bombs to KA over the phone, who in turn called BR telling him all about it. April 3rd - June 14th, Ricky's gotta be crazy folks if we're going to pull this off.

The videos hand picked out and shown by the Defense did not support the alleged POW mistreatment or abuse by the guards or prison officials, according to at least one of the jurors that we know of so far. I'm sure we'll hear more.

RA was and is the danger. Just like he was during his time in Westville and also during the trial when he lost control and threatened the guards at the CCJ.

Just like he was on Feb 13, 2017 when he viciously and brutally murdered to innocent young girls Abigale Williams and Liberty German. He is exactly where he deserves to be and they can appeal until the wheels fall off the clown car. RA isn't going anywhere, he is the convicted perpetrator.

Abby & Libby are the Victims and the ones who should be mourned, cared about, and lovingly remembered for all that was so brutally and selfishly taken from them by that monster. He took their earthly lives, but he didn't take their spirits.

The juror, who observed those henpecked videos stated she was expecting the conditions to be worse than what they appeared on the videos to her. Defense is playing for sympathy & loses sight of the fact, IMO all too often, that how RA was treated has nothing to do with his involvement in murdering 2 girls. They’re consistently playing darts blindfolded at every turn.

As you know, in general I found the D's interview with LL to be mostly softball and highly unconvincing. However I felt Rozzi did make some strong points about Westville. This was the Ds best trial argument IMO, which ultimately fell apart because of the van.

I happen to agree with Rozzi that what happened is not constitutionally great. However what I am not sure about is whether the administrative state ultimately really needed the permission of the Judge when deciding where to put him? So sure his lawyers can challenge the nature of his detention. Always. But was a hearing in fact necessary? i don't know the answer on that, but i suspect once you are detained, the administrative state has the freedom to do what it likes in terms of where it decides to put you ... Of course those decisions can be challenged in court by your attorneys, but do they have to ask first? (IDK)

One suspects RA won't succeed on appeal on these issues. For instance, what was stopping the defence challenging all this on 14 November 2022 when first appointed?

Kathy, a volunteer and lifelong Delphi resident turned down the reward money…instead telling the families of Abby and Libby “that the funds should instead be funneled into the memorial softball field and foundation established in memory of the girls”- Daily Mail

It's a very wonderful and dear person that would give that reward money to honor the victims Abby & Libby.
 
Prosecutor Nicholas McLeland interviewed by TMS.

Thanks Megs, I was particularly surprised that Nick McL started out as a Defense Attorney. It makes sense how he was so effective in his cross of the D's witnesses (Pearlmuttter in the pre-trial hearings anyone?).

He came across very well spoken and professional, just as he has been described by many during the trial. It's too bad the Defense Team and their Cranks painted a horrible misrepresentation of him such as this was his first murder case (not true), he was too inexperienced and unprepared (the exact opposite), he was Judge Gull's pet (just sick and wrong accusations).

He's been described as highly professional and being far more prepared than the Defense now that more people are starting to open up. He won a guilty verdict when basically everyone doubted it (not me), maybe there was a little jealousy from the popular, so called 'seasoned professionals' on the other side of the table?

Throughout this interview and the one he did with the local media he did not badmouth or imply anything negative about the Defense, which shows me his true character. Conversely, it shows me the utter lack of character shown by the Defense just reading the highlights of the interviews done by Rozzi, Baldwin and Auger lately. Imagine that. :rolleyes:

same song, different day. there is no "new" evidence re a confession by a SODDI. they know the jury believed the boxcutter testimony put forth by the prosecution and have now miraculously located a prisoner who claims to be willing to lie under oath that another prisoner admitted to killing the girls with a boxcutter (MOO). The state had every right to move RA to an appropriate facility and didn't need his attorney's permission or a hearing to do so. No false evidence was presented regarding the arrival of the van into the area near the murder, and finally, nobody believes the phone was plugged in, powered off and back on by a human or headphones placed into the jack. Period. Stick a fork in him, he's done, and I am pretty much done following. That plump woman has sung and the rest that follows is simple desperation. JMO

This, of course, was not true (in my opinion) and the FBI agent was going to testify that Brad Weber told him differently, in my opinion. Nick McLeland KNEW this (in my opinion) and said he would not agree to the FBI agent testifying to this remotely (despite a life-threatening medical condition making flying dangersou), right there in the year 2024 when that would be oh so easy.

Why'd he say no? Because he would have lost the case and we can't have that! (In my opinion)

Nothing “hinged” on BW arriving home when he said he he did. I’ve always found that dubious, so it didn’t factor in to my belief that Allen is guilty.

It’s the timeline before that, and everything else.

So that erroneous information/testimony means nothing to you? The van information was CRITICAL to the jury, per the juror who has spoken out. With that off the table, would they have come to the same verdict?
