Another update on WISHTV….


Diener ended her cross, and the jury asked several questions about Allen’s mental health history.

  • If Mr. Allen has the common sense to be afraid to leave his cell, would he have the common sense to fake his symptoms? Westcott said Allen’s statement about being afraid was before his psychotic episode.
  • If he was depressed as a child, would that cause him to commit crimes as an adult? Westcott said not always and that it depends on the personality type.
  • Would depression as a child cause them to become a sex addict? Westcott said no.
  • Did you watch Allen’s police interview in October 2022? Westcott said yes.
About whether Westcott watched the police interview:


A juror asked if Wescott watched the police interview with Allen. Wescott said no.

I’m glad the doctor explained that Wala’s “story-like” and coherent recounting of RA’s May 2023 confession was inconsistent with his behavior and other phone calls he made that day. I suspected as much.

Hmmm did the state not get a deposition because they didn't want a record of what she had to say?
? I don't follow your question here. The record of what she has to say is her trial testimony. Failing to depose her doesn't accomplish what you seem to be suggesting their motivation was?
 
We know they did, and the FBI assisted with that. They tracked down the phones that were on the trail during a particular time period. Plenty of other things they did poorly though.

Allen was first investigated in 2017 and again in October 2022. After a second police interview, he was taken into custody.

Carter said the FBI stopped their involvement in August 2021. Defense’s Andrew Baldwin showed Carter an email from the FBI, which Carter confirmed to the jury was his decision to release the FBI from the investigation. He also also requested the FBI return any evidence.

Wala told the jury on April 5, 2023 Allen discussed his case with her, unprompted.

Wala said Allen claimed he molested his sister and experimented sexually with male and female children his age when he was a kid. Wala said Allen told her this is where he thought his problem started.

Wala told the jury Allen said he had been an alcoholic twice since 2011. Allen told her he accepted God on March 21, 2023 and expressed remorse for the killings, according to Wala.

 
Has FBI phone forensics testified during the trial at all?
Nope. Probably because that would make too much sense.

It looks like ISP used their own guy, and although the Feds were involved in that aspect to an extent, we don’t know to what extent.

This is usually one of the most compelling parts of trial, and they don’t seem to have gone in depth with it at all.

Allen told Wala that he was a recovering alcoholic but that he drank three beers on Feb. 13, 2017, before heading to the trails.

He also said he was an alcoholic and had been both a victim and perpetrator of child molestation.

Dr. Wala testified that Allen was an alcohol-dependent sex addict who admitted the murders were “sexual in nature,” according to the Indiana paper, though a medical examiner found no evidence of sexual abuse during the autopsies.

You can opt not to believe RA's confessions, but he DID say he was an alcoholic. Of course some will say that was just the "psychosis" talking.
 
Looked up alcoholics - especially those that can maintain a strong level of order in their daily lives.

Question: Does anyone know if Richard Allen is a high functioning alcoholic or not?!

IMO, yes he was high functioning.

He was able to maintain full time work and was even promoted;
He was able to study to become a Pharmacy Technician and was successful in those studies;
He and Kathy travelled, at least for hikes - alone and together;
He carried out routine daily tasks by all by himself such as driving (to/from work - his mom's house);
He maintained a public social life in the pool hall; and
He was capable of hiding in plain sight ... until he wasn't.

IMO.

11:29 A.M.: NEUROPSYCHOLOGIST WHO EVALUATED ALLEN TESTIFIES​

Richard Allen entered the courtroom Monday morning wearing a blue-striped button-down shirt and khakis. He was carrying a Bible, News 8’s Kyla Russell noted. Allen apparently showed defense attorney Andrew Baldwin a verse when sitting with him.

Special Judge Fran Gull and the jury entered shortly after 9 a.m., and the defense called their first witness, Dr. Polly Westcott.

Westcott is a neuropsychologist based in Carmel. She told the court her specialty was in forensic psychology and neuropsychology. Baldwin and defense attorney Brad Rozzi hired Westcott in May 2023 to assess Allen’s mental, emotional, and physical health decline while he was in Westville.

Westcott was given access to Allen’s mental health treatment records, video footage from the prison, and access to his recorded calls. She told the jury she received more information about Allen than she had in any other criminal case she’s worked on before. Russell noted that Westcott stopped receiving videos of Allen in March 2024.



That was a good read.

‘No indication of faking or any type of exaggeration,’ neuropsychologist testifies.

I feel this is one witness that appears to be objective with her analysis and specialises in Forensics and Neuropsychology.

Not sure that has any bearing on the case, but "if" he is clinically an alcoholic and I don't even know if that has been determined except from a claim he made he seems to have been high functioning enough to hold down jobs etc. etc. If I recall he had had no trouble with the police so I'm assuming no DUIs or any of the typical things you find out about an alcoholic. But again he could be the weekend warrior type who drinks on non work days...we just don't know and again not sure it has any bearing on the trial.

IME, lots of high functioning alcoholics are also the Street Angel/House Devil variety.
 
They could use prior deposition testimony to impeach her.
my response was to to the suggestion that the state for some reason didn't "want a record" of what this Dr. had to say. They have her report. That is a record. They know what she intended to testify to. Why would not deposing her keep there from being a record? She prepared a report and is now testifying to it's contents?
 
I surprised you don’t recall, he admitted he’d been was alcoholic twice since 2010 if I remember the year correctly but sorry I don’t recall the source who reported it. However it was definitely posted about in these threads.
Well I found this and remember hearing a similar report:

It was early April when Allen made that comment. Of course, it makes no sense. And this was during the same conversation when he said he killed all of his family and would kill himself by standing on the sink. He also stated that he started WW 2.

To me, this does not sound like a legit admission to being an alcoholic. JMO

Mentioned because the article cited above Delphi Murders trial: Day 15 live blog claims

"She said she gave him a MCI, or mild cognitive impairment test, which is a comprehensive test for personality features and mental health disorders. The test also evaluated if Allen was faking his symptoms.

The state objected again, saying they asked for a copy of these results but did not receive them. Rozzi explained they could only be given to a mental health professional, and that the state “did not even take the time to take a deposition of Westcott.”"


And I wondered if she were on the witness list for the defense and why prosecution wouldn't depose her.
 

Diener asked if a psychotic person could say something that is accurate.

Wescott said, "Yes."

Diener asked how Wescott decided what to put in her report and what to leave out. Diener asked why Wescott left out Allen's confessions on April 5, 2023 and May 3, 2023.

Wescott said Wala's report was a summary and not direct quotes. Wescott said her job was to identify Allen's mental health symptoms that would explain his psychotic state.

Diener said Wescott chose to leave out Wala's notes that Allen did not appear to be psychotic. Wescott said Wala's report does mention behaviors consistent with psychosis.

Diener said there was an amended report. Wescott said she didn't receive the amended report.

Diener asked if Wescott listened to all the phone calls Allen made to his wife. Wescott said she listened to phone calls but couldn't be sure if they were all of them.
