I'm talking about the evidence they weren't allowed to see. <modsnip - not a suspect> All of these decisions guarantee an appeal, but RA may not live that long, sadly.

There has to be probable cause to accuse someone! There was no evidence that would shift the blame or change the outcome. There is definitely no guaranteed appeal. Quite the opposite, as the court erred on the side if the defense. If you read the 3 day hearing, you will see that there was not evidence to accuse anyone else. It wasn't just "not allowed". There was nothing there to bring it forward. You cannot just blindly accuse people of murder because you don't want it to point at the murderer!

Just another thing that is odd but I wouldn’t be surprised if Judge Gull’s forced secrecy of the trial and proceedings being accessible to the public don’t become an issue.

I’m not saying RA isn’t the perpetrator, I’m not saying the jury got it wrong, I just think there are a lot of items about this whole case that are questionable, MOO
It won't. She was fully within the law to do so. It happens in my area of the country all the time, no cameras.
 
Allen faces a sentence between 45 and 130 years. He was convicted on four counts, but he will be sentenced on only one per girl because he cannot be sentenced twice for the same act. The sentence for murder is between 45 and 65 years. If Allen's sentences run consecutively, that could mean a sentence of up to 130 years. If the sentences run concurrently, that could be as low as 45 years.
The advisory sentencing for judges to consider for murder starts at 55 years, and then the judge can lower the sentence or raise it, depending on mitigating and aggravating factors.

 
These charges are not aggravated, meaning the sentence can't be LWOP, also why they couldn't go DP.

The Judge will decide the sentence, the range is 45-65 years. With an advisory range of 55 years.

This is per charge hence the max 130 we see floating around.

(1) The defendant committed the murder by intentionally killing the victim while committing or attempting to commit any of the following:

(A) Arson (IC 35-43-1-1).
(B) Burglary (IC 35-43-2-1).
(C) Child molesting (IC 35-42-4-3).
(D) Criminal deviate conduct (IC 35-42-4-2) (before its repeal).
(E) Kidnapping (IC 35-42-3-2).



What was RA convicted of, again?
 
I feel for these jurors. I think some, it not all, are going be retraumatized once they hear about all the evidence they weren't allowed to hear/see. I'd be livid if I were them. Maybe some of them will even join the appeal fight.

There was no other admissible evidence, as ruled after the 3 day pretrial hearings, where it was brought in and it was shown to have no nexus, it wasn't substantive. End of story.

Yes, that's exactly my point. If there are loads of us out here (in my opinion) who have a problem with the evidence not being admissible, I'd bet a lot of money the jurors will have a problem with it too once the learn about it. I feel badly for them.

I feel badly for them, too. They had to be thrown head first into hearing about how this monster terrorized these 2 children. Made them strip naked. And then they had to see photos of 1 nude child and 2 children who were BRUTALLY murdered. They never asked to be part of this. In aaallll the things I can feel sorry for then, no where would it be baseless conspiracies at the top of that list, much less anywhere on the list. Give them the respect they deserve. They poured over this difficult information and came to the correct decision. No fake odinist would ever change that.

Or the group of RA supporters is the result of a PR savvy group of ppl leaking twisted info and playing with ppl's minds, banking on our intrinsic disbelief that a seemingly normal neighbour could snap and become evil incarnate, and the growing sense of dissatisfaction with the state/government. One for the books.

I'm trying not to be pessimistic but I am going to bet that we will see those same faces try to latch on to the Idaho case next. Follow the clicks.

As the jury exited the courtroom, ISP Superintendent Doug Carter reached back and squeezed the hand of Becky Patty. Carter could be seen with his head in his hands and crying as the verdict was read.

With the courtroom nearly cleared, family members of the girls hugged McLeland and deputy prosecutors Stacey Diener and James Luttrell, as well as ISP Lt. Jerry Holeman. Mike Patty walked to the back of the room and shook the hands of law enforcement officers, among them Dan Dulin, who took Allen’s statement in February 2017.

Mike could also be seen hugging Kathy Shank. Shank was a volunteer on the investigation who found tip #74, a tip lead sheet marked as Richard Allen Whiteman. That tip was a self-reported tip from Allen stating he had been on the bridge between 1:30 and 3:30 p.m. on Feb. 13, 2017, wearing clothing similar to Bridge Guy. Shank recognized Whiteman as a street in Delphi. When she read the file, it said, “Richard Allen, who lives on Whiteman Drive ….” She took the tip to Sheriff Tony Liggett, who initiated an investigation into Allen.

I actually do feel sorry for the people who fell for the lies. Because good people were tricked. It's embarrassing that they were able to dupe people because they can get popular and make money off of them. I hope these liars are next to receive charges for publicly accusing innocent people with no basis for doing so.
 
If the jury was allowed to sentence defendants, they probably wouldn't be allowed to go home for the holidays first. JMO

As it always is, this is my opinion.

Hmmm.... I thought sure I said in my post that I was stating my feelings which had nothing to do with the law. Perhaps I wasn't clear... it happens sometimes.

And, I'm all fine and dandy with Judge Gull sentencing Richard Allen.

I truly hope the emotions that the DT camp has generated go into voting for prison reform and funding the Innocence Project.

I 100% support both causes whole heartedly. I don't support half-baked theories of SODDI but are there people behind bars who should be getting mental health support and better representation? 100% yes

DC... I was never delighted with the content of his public appeals but I never once doubted it always came from a place of real care for Abby and Libby and their families. Bless them all for getting us here.
