If RA feels he has been let down by his counsel he has no one to blame but himself.
Judge Gull tried to save him from these blithering incompetents and their cohort, the unethical Ms. Auger, but RA and his entire clueless family insisted they stay.
That’s true.

On one hand, I’d like to see a non-Odinist defence, on the other hand - is it worth it…at all?

Gull finished the MTCE issue.

RD was uncooperative until after the trial was done. I imagine the D team felt the juice would not be worth the squeeze. I agree that the defense team made mistakes. shrugs... maybe that will help RA will get a new trial.

I'm really sorry so much of this case was kept secret.
No, RD told Baldwin to watch interview videos & AB forgot about RD for the remainder of the year after that first meeting they had. RD was allegedly writing letters just before the trial & failed to copy the defense. He was quite cooperative prior to the trial according to AB, hence the "slipping through the cracks" BS.

The MTCE has been ruled upon yet here we still see motions coming from the defense over stuff that inculpates their client when they claimed it would exculpate. Baldwin has apparently lied so much he can’t remember his stories now.

File away, Andy, you still can’t get your boy off that bridge. Yet here we are still hearing SODDI malarkey.

After being seen walking on the road, he walked behind the Hoosier Harvestore building.
If the HHS surveillance video is ever released to the public, I want to see how wide of an area it recorded. The HHS surveillance camera is on the side of the building so how wide of an area did it view? It must be able to see the road.

I think they said the security camera only picked up things in front of the building, which of course, includes the road.
I don’t think it will show the side of the building or anybody walking toward it or walking behind it.
RA said he walked back to his car that he said he parked at the old CPS building.

Don't forget about the Haas letter concerning Logan. I've never seen that one.

Yes, I realize I had this HHS surveillance camera fact wrong by looking back at the news footage. It looks like the surveillance camera is in front of the HHS building. It also does not appear to be in a dome, but facing the road. It looks like it is a single camera facing the road. If I could delete my previous posts about the HHS surveillance camera location I would.

If the reason he left the road was because of the witness SC around 3:57pm, then it makes more sense he was not seen on the HHS surveillance camera. I do not know what news footage I had seen before that made me think the HHS surveillance camera was in a dome. It is not. It is in front of the building and is a single surveillance camera facing the road.

Somehow Richard Allen avoided the HHS surveillance camera on his way back to his car at the old CPS building at around 4pm on February 13, 2017.

Nick produced letters from OCT24 which AB stated were exculpatory. They were not exculpatory. Once again, AB says & it’s taken as fact. Who even says NM has tapes to hand over? Wasn’t there this larger LE group involved whose handwriting notes they couldn’t interpret? Maybe ask THEM where that tape is located. Real easy for AB to wave his wand & make things appear differently through a motion yet AGAIN. What, 8 months ago & it was horse worshippers doing all the dirty deeds? Has nothing to do with correcting errors. It’s putting names on a record that were never supposed to be there in the first place due to the motion disallowing 3rd party involvement.
 
At it's most generous, ABs argument appears to be that the letters are still exculpatory even though they accuse RA, because KAK lied to RD about RAs involvement in order to protect a 3rd party - so RD was being truthful about a lie he was told. But the other parts are exculpatory. Or something.

I feel that is a longshot - but that is the logic to it.

I have no idea of the case law in this area, and I guess it would have been better to discover these. I presume in the heat of the trial no one gave much thought to rando letters.

I feel like the fundamental problem with trying to make this stick is the D themselves had interviewed this witness and subpoenaed him, but just chose not to call him. Would these letters have changed the calculus? Or course not. These letters would be a disaster at trial, even if the judge allowed it, which of course she never would have.
 

TMS says up front that the latest AB filing is so without merit, that the episode isn't worth your time.
 

The first half hour is unpacks RicciDavis' unsupported story and highlights his lack of credibility, including that the Defense wants RD to be believed except where he says basically the Defense encouraged him to lie. So he's a liar but you can believe some of what he says or he's telling the truth except for the lying part.

Plus the letters don't exonerate RA, they implicate him!

Around 29 minutes, KG says of the defense: they had a weak hand and they played it remarkably badly.

KG: must have stung for the Defense to lose to McLeland who they thought was inexperienced, a rube they could beat but instead he dominated. So, much of this is "their attempt to deal with their psychic wound".

Didn't do a particularly good job for RA, didn't rise to the level of ineffective counsel. "They were certainly vigorous in what they were doing, I just don't think it was good. I don't think it was truthful. Frankly, I don't think they did it with dignity."

Right, backed in at the furthest spot down on the side of the building with no other cars around it. Easy peasy. IMO
 
I guess there are no sanctions for just being an incredibly bad lawyer, but surely there must be some way to stop wasting the court’s time.
We still have no answer on whether or not Baldwin is still receiving the good people of Indiana’s money for this silliness.
It is beyond me why RA and his family are unable to recognize that Baldwin is doing him no good at all. The trial is over. Give it up to the appellate court.

Becky in her interview with Lauren said Baldwin told RA to ignore the noise (victim statements) and he also said in an interview he rush up to RA afraid that RA would said something that prejudice his appeal. I don't understand Baldwin's problem. The final decision is ALWAYS form the client. Attorneys can advise, say "it is better for you that you don't said/do that" but if the client wants to say something/confess even if the attorney feel the client is innocent (right right), etc THE FINAL DECISION IS FROM THE CLIENT. If the client want to say something, he has that right. Unfortunately, RA is also a weak man and does not impose himself on his lawyers and wife.

I believe TMS was the first to push for transparency. Have they ever mentioned why they aren't among those who are pushing now?

Maybe because they attended trial and watched the 💩 show that was the defense in action ad now understand why JG ruled the way she did on that issue? Just a guess.

Media access to sealed evidence?
Yes, or even public documents that aren't available to the public.

Do you mean transparency of the trial itself?

They weren't fans of the media blackout, to be sure. Disagreed with the judge. Didn't like the procedure for gallery seats. No one did.

I think it does show their neutrality, for lack of a better word. Critical thought, impartiality.

They supported some of Gull's decisions, rejected others.

By and large, they were impressed with her control of her courtroom and give her high marks over all.
