D's not deflecting the evidence against RA, which imo is a fatal error, but perhaps one beyond their control in that it cannot be deflected. If the D chooses to ignore the evidence posed by the P against their client, they can't really espouse some wack alternative theory that falls on its face. It has to have some teeth to it.

But that's just what they're doing, they are indeed espousing these wack theories, and these wack theories are falling on their face. And D's point of refuge will be-- appeals. It "shoulda been" the Odinism.

Don't count on it. The judge knew what she was doing in this case. If you need any evidence of that, look at the "new" D strategy. Does it look convincing? Does it even dovetail with the prior theory? Were the current conspirators now being discussed by the D carpooling with the Odinists, and they had no room in the car for muddy bloody BG? So he was hanging out on the road walking to his own vehicle-- really??

Or does it look like D's throwing darts to desperately find something that doesn't hit "Rick"?

It's not an entered order at the link. Is it a proposed order set forth by the defense to accompany their motion for transport or . . .

I cannot access the docket, can someone who has access and see if this order was actually entered? TIA

I think it is more likely that the battery was fine (battery charges usually last 18-24 hours)... but that the reception was very bad down in that low lying sheltered dip in the woods. Over millennia, that creek has carved a small gorge or canyon out and hard to get a signal in there.

As we all know signals are not constant and sometimes other environmental things can happen to make the signal suddenly just be enough to connect... weather conditions play a role as well as sometimes a plane flying overhead will momentarily "bounce" a signal that it saw directly and bounces it down in a clear straight line to the phone.

Just me talking but to me, probably weather humidity, temperature, wind... created the right combination and texts are not much data at all. that could transmit to the phone if they only had a second or two.

Recalling my own personal experience with the iPhone 6s, the battery was extremely unpredictable and most users were forced to set device settings to save battery life producing the following results-- some which also delayed fetching messages:

Apple/AT&T put out the following recommendations for setting on an iPhone 6s to save battery life:

>Low Power Mode: This setting reduces power consumption by turning off or reducing background app refresh, mail fetch, automatic downloads, and some visual effects.
To turn it on, go to Settings > Battery.
>Screen brightness: Lowering your screen brightness will help extend your battery life.
>Wireless services: Turn off Wi-Fi, Bluetooth, and cellular data to save battery life.
>Face down: When your iPhone is not in use, turn it face down to prevent the screen from lighting up when you receive notifications.
>Auto-brightness: Turn on auto-brightness so that your phone's sensor can adjust the brightness based on the surrounding light.
>Notifications: Disable non-essential notifications, like push notifications for games.
>Dark mode: Turn on dark mode to save battery life and make your phone easier on your eyes.
>Location services: Go to Settings > Privacy > Location Services > System Services to disable location-based system services you don't want running.


ETA: This was so bad it went from battery replacement to lawsuit...

I dunno. Wouldn’t you want to call a convicted sexual predator who had contact with one of the victims?

What do you see as the pitfalls here?
The guy is not credible at all, and his testimony would likely be to implicate some other party. A main rule of lawyering is to not ask questions you don’t already know the answer to, and I have a strong feeling the defense doesn’t actually know how he will answer to anything they ask him. Even if they interviewed him prior, I’d be very wary of him giving the same answers once on the stand. All he does is lie.

I wasn’t particularly referring to the time. I was simply imagining the chaos of committing the crime alone. If you’ve got two young, frightened girls and a gun in one hand to intimidate them with, two bladed knives hidden somewhere on your body and any other equipment you thought you might need, and one runs, what do you? Shoot her in the back and kill her, while the sound of gunfire permeates the area and draws attention to your location? In the meantime time the other girl is screaming and crying and possibly running away in the other direction.
So do you the fire another shot to kill her? And what if you miss, fire again? Now you’ve got people hearing more shots, who aren’t afraid to get involved and dial 911 on their cell phones. Now where do you go, back to your car and hope no one sees you or do you just run? Now you’ve left your spent gun cartridges everywhere.
The girls had no rope burns on their hands or bodies, no gag marks or duct tape residue on their faces. How did he physically control them both, with either a gun or one of two knives in his hand?
“Fight or Flight” is a natural survival mechanism that we’re all born with and no matter how close of friends the girls were to each other, I do not believe they were just being brave and stood by each other to the end.
It’s a strong life preserving response controlled by many body systems and I doubt young girls were mature or strong enough to die for each other. They had no defensive wounds, and no identifying DNA under their nails, so how did this killer do it alone? I’m just trying to understand how it was possible without any help. IMO
The oft forgotten other side of fight or flight is fawn or freeze. The subconcious makes a split second choice at what will best aid survival. No telling what your body will do until you are in the moment. It was terribly risky, I agree, but not a forgone conclusion that the girls would fight or flee. Just my opinion.
 
9:08 a.m. The state called Kathy Shank. Shank acted as a “secretary” for the investigation. She would take tipster’s names and information. Shank said she worked with 50 or more law enforcement officers while working the investigation.

Shank told the jury she was given “bankers boxes” of reports related to the investigation and was asked to organize the reports. Eventually these reports took up five filing cabinets. Shank said she created a filing system with names of people of interest, tipsters, etc.

Shank told the jury that in 2020 she was asked to scan every file from the filing cabinets into an electronic database. She said it took her two years to do so. Shank told the jury she did not read the entire context of every file and she entered over 14,000 of them.

She told the jury that at some point she came across some hand-written tips, one of them said a “Richard Allen Whiteland” had “self-reported being on the trails and girls had seem him at the same time.”

That tip was dated February 16, 2017.

And I expect he’ll thrive on the attention as in his head he’s a celebrity. I regret anyone is giving him that attention and he’s not about to incriminate himself. JMO

So now they’re pivoting to RA and RA = BG.

Called him to ask to meet at house, Allen said no. Suggested police station, Allen said no. Asked where and Allen suggested Save A Lot parking lot.


Met there and confirmed correct name is Richard Allen who lived on Whiteman St.

He said in 2022 he also went into DNR files to see if there was anything there and found that on 4/1/17, which RA applied for a new fishing license, he reported a new height and weight. The change in height was from 5’4” to 5’6”. He thought that was unusual.

Well that is interesting. Blast from the past. Ives was just talked about on the threads Monday and yesterday. So, defense suddenly decides they need to have him testify. Light-bulb moment triggered by social media chatter?

Can I ask why would the defense need to say the girls were taken away and returned to the CS?

How would that help the defense? I am struggling understanding that motivation. help me
I suspect it's because the can alibi Allen for the 0433hrs timing, but not for the time of the actual murders.

The Defence needs to move that timeline.

Did RA have to go in to CVS early the next morning to receive a delivery, do some stocking??
 
Sounds like a pretty busy scene for just one man to manage by himself. IMO
The only thing I can think of is he told them to undress, Libby took off her top (under threat/duress/at gunpoint) and Abby took her pants off. Maybe they just started undressing differently, one top first the other bottom first then the interruption or BG got spooked and made them go to the final crime scene.

Doesn't really explain why they were in the creek as opposed to on either bank or at the final crime scene. I also don't remember when the "interruption" happened so could be off on that. MOO
 
He thinks it’s weird to change your height on a fishing license but seems like he didn’t say it was unusual to talk in a grocery store parking lot instead of at the station, that to me is more unusual
I suspect the reason the changing locations was brought up is because it’s unusual, but that is self-evident. The height change was probably asked about specifically by the prosecution to give the jury a frame of reference for whether that is something commonly seen or not.
