NM is going to ask witness on cross if it possible for someone with SMI, an admitted alcoholic to commit murder and remember it.
Cross should be interesting on this witness.

Notice how the defense put this witness on before showing the rest of those videos.

Defense's own psych witness fills in the remaining blanks for me. RA was never this meek, friendly, ordinary CVS worker. Troubled, unwell, RX and alcohol mixing, damaged creature who was not getting enough attention so he went postal, low self-awareness, high neediness, he is a perfect candidate for harm. He's either going to hurt himself. Or someone else.

That day he lashed out. Slashed out.

He's an angry, demanding, dangerous man.

Does he feel like a VIP meanwhile? Has he a sense for fashion and trends, wearing his glasses like he always does? Glad to have some pic of him, but actually I don't want to see him.

I am still puzzled why Abby was dressed in Libby’s clothing. Was there any explanation during testimony? That being said, I feel like the prosecution has done a solid job.
I wonder why Dr. Wala didn’t ask him that very important question during her “sessions” with him?? I mean that would be a detail “only the killer would know,” right? OR did she and all she got was nonsense? JMHO

Another update on WISHTV….


Diener ended her cross, and the jury asked several questions about Allen’s mental health history.

  • If Mr. Allen has the common sense to be afraid to leave his cell, would he have the common sense to fake his symptoms? Westcott said Allen’s statement about being afraid was before his psychotic episode.
  • If he was depressed as a child, would that cause him to commit crimes as an adult? Westcott said not always and that it depends on the personality type.
  • Would depression as a child cause them to become a sex addict? Westcott said no.
  • Did you watch Allen’s police interview in October 2022? Westcott said yes.

If so, wouldn't it had showed up in the geofence thingy? It doesn't sound like it did. So my guess is there wasn't another phone over.
Can some one point me in the direction of the geofence results please?

And add alcohol to that. That explains to me why the pub video gave me the impression his wife was there to supervise him. Now I really do think she was.

Dependency personality disorder, he behaves in her presence requiring her approval. Unfortunate she wasn’t babysitting him Feb 13, 2017. JMO

IMO This would have absolutely destroyed her credibility. I think she was unprofessional, but there was no evidence, to my knowledge, that she introduced elements of the crime to him during their sessions. Asking him about specifics that he didn't bring up would have made the confession with details absolutely worthless.

Defense's 12th witness, Dr. Polly Wescott, a forensic psychologist​

9:10 a.m. - The defense's 12th witness is Dr. Polly Wescott, a neuropsychologist who specializes in forensic psychiatry.
In May of 2023, Wescott started working with Allen's defense team at a rate of $450 an hour.
Wescott has testified as a witness for both the state and various defense teams.
Wescott said she worked with inmates at Wabash Valley Prison and the Indiana Women's Prison. Wescott has also worked with police crisis intervention teams.
Wescott said when the defense team reached out they wanted her to do three things:
  1. Look at Allen's mental health history.
  2. Do a neuropsychological exam
  3. Determine the breadth and context for his mental decline during the time of his confession.
Wescott started off with Allen's mental health history and records. Wescott said she watched and listened to Allen. She also watched "extensive video footage" and "listened to phone calls" Allen made from prison.
Wescott said it is "very unusual" to get to see 20 hours of video footage of a patient and review suicide watch notes.
Wescott said she saw Westville and Wabash Valley video and information through March of 2024.
Wescott met with Allen in August of 2023 and performed an evaluation. Wescott said this was a two hour evaluation and a five hour test over two days.
That answers that question about whether they actually met with him then.

In my opinion, yes. He was dressed in layers. He may have had gloves on. The crime scene wasn’t clean. He left behind a bullet from his gun and a cell phone that had incriminating evidence on it. He was spotted by multiple witnesses.

Looked up alcoholics - especially those that can maintain a strong level of order in their daily lives.

Question: Does anyone know if Richard Allen is a high functioning alcoholic or not?!

The defense attempted to enter a clinical MCMI test that was administered to Allen. The state objected that they did not get a detailed copy, only a summary. The defense said the State didn't take the time to depose Wescott in the last 18 months, and that the results were available to them for months. The defense said they asked for assessment tools and told no. The judge sustained the objection, blocking the results.
Hmmm did the state not get a deposition because they didn't want a record of what she had to say?

Since when is RA an admitted alcoholic? I’d love to see a source for that.

Yes but not until August 2023. That’s quite some time later, after his confessions that he was evaluated by her IMO.

11:29 A.M.: NEUROPSYCHOLOGIST WHO EVALUATED ALLEN TESTIFIES​

Richard Allen entered the courtroom Monday morning wearing a blue-striped button-down shirt and khakis. He was carrying a Bible, News 8’s Kyla Russell noted. Allen apparently showed defense attorney Andrew Baldwin a verse when sitting with him.

Special Judge Fran Gull and the jury entered shortly after 9 a.m., and the defense called their first witness, Dr. Polly Westcott.

Westcott is a neuropsychologist based in Carmel. She told the court her specialty was in forensic psychology and neuropsychology. Baldwin and defense attorney Brad Rozzi hired Westcott in May 2023 to assess Allen’s mental, emotional, and physical health decline while he was in Westville.

Westcott was given access to Allen’s mental health treatment records, video footage from the prison, and access to his recorded calls. She told the jury she received more information about Allen than she had in any other criminal case she’s worked on before. Russell noted that Westcott stopped receiving videos of Allen in March 2024.

Sort of off-topic but since multiple people have remarked on the courtroom art & RA propping his glasses on his head.... I would assume they are reading glasses, so unless he's reading something, he probably doesn't need to wear glasses. I see many people prop their glasses up like this -- keeps them convenient when you need to read something.

they had a copy of her lengthy report. They probably felt like they didn’t need her deposition.

In a court ruling Wednesday, Special Judge Fran Gull granted Carroll County Prosecutor Nick McLeland’s Motion in Limine.

That motion requested the prohibition of several topics in opening statements, presentation of evidence, or closing arguments including theories of Odinism, third-party suspects, cell phone tracking/geofencing data, previous investigations by Todd Click of Rushville Police, references to bad acts of any witnesses that plan to testify, references to PowerPoints provided by the State involving investigations into previous potential suspects, and more.

Since when is RA an admitted alcoholic? I’d love to see a source for that.

I surprised you don’t recall, he admitted he’d been was alcoholic twice since 2010 if I remember the year correctly but sorry I don’t recall the source who reported it. However it was definitely posted about in these threads.
